S Pass renewal delays - DP cancelled

Post by Ashmi » Sat, 04 May 2013 1:13 pm

Hi,

Before 1 week of S pass expire date, my company applied for renewal. After expire date only we got a mail from MOM asking for some docs. Now waiting for the result and got 2 week extension for my stay here.
My problem is dependant pass renewal. My family is with me in DP. My salary is <4000. Now my S pass got expired and unable to get extension for my family, MOM asks us to cancel DP to get 1 month stay pass. Now my doubt is whether i will get DP after my S pass renewal since salary is <4000. Plz clear my doubt
Ashmi

A regular base salary of S$4000/month or more is required to get a DP for spouse/children.
The requirements were more lax when you got the previous DP, but the new (higher) thresholds will be applied for a new DP.
So, if you don't fulfill the current requirements, your family might have to return home.

Why did your employer wait until one week before your S pass expired to apply for a renewal? This should be started anywhere from 1 to 3 months before your expiry date.

Beppi, small addition/correction to your statement....
How will the changes to the
dependant privileges affect existing dependants of EP and S Pass holders?

A3 The changes will only apply to all dependants of EP and S Pass holders who arrive in Singapore from 1 Sep 2012. To reduce disruption to families already here or who have already made plans to arrive soon, dependants of EP and S Pass holders who are already in Singapore or will be arriving before 1 Sep 2012 will be allowed to stay as long as the main pass holders have valid passes. This is on the condition that MOM received the applications for the stay of the dependants before 1 Sep 2012.

Such dependants can also remain in Singapore when the EP or S Pass holder has his/ her work pass renewed, for all renewals taking place on or after 1 Sep 2012, so long as the pass holder remains with the same employer
.

I'm pretty sure that is what you meant. And considering his employer let his pass expire, I'm pretty sure he's well & truly been fuqed by the employer waiting too late to renew the passes expiry.

Ashmi, we cannot clear your doubts, but it's going to have to be the chance you take. But be advised that you better start making a Plan B, because I think you might need it. The MOM & ICA are actually human beings, so they may be compassionate enough to reissue the DP's even though there is a break between the two passes, but this would only be if they recognize the fact that is was no fault of your own and it would be a hardship on the family as you are still working for the same employer. This is purely the fault of your employer from my point of view.

I assumed that, if he cancels his family's DP and put them (temporarily) on an SVP, the new rules will apply for the subsequent applications of a new DP - which means no new DP can be issued.
If I were the OP, I would avoid cancelling the old DP at all cost, as this might mean the only chance to continue staying here with his family (provided the S-Pass gets renewed).
But OP is probably well advised to ask ICA and MoM about this instead of an Internet forum.

I definitely concur with your last sentence.

Ashmi, the DP's are not valid unless your S pass is valid (e.g., not expired). If you don't cancel them, you could find yourself with a family of overstayers. Not Good! MOM says to cancel them, then you better as at least with the SVPs they are here legally, Without the S pass, they are illegals in law.
Cancellation of Related Passes
Please note that when the main pass is cancelled or revoked due to levy default, all other work passes linked to the S Pass will be cancelled unless the related pass holder has become a Singapore Permanent Resident. The Dependant's Pass can be cancelled through EP Online. Failure to do so will result in the Dependant's Pass becoming an overstayer.

The S Pass shall be deemed to be cancelled from the date the employment is terminated. The holder of the S Pass shall not remain in Singapore after the date the employment was terminated unless he is otherwise entitled to remain in Singapore with a valid pass.
