Pre termination penalty in employment contract

Well, it goes according to the contract if it is a penalty or not. In any case, even cost occurred to the company they would have to justify - and you can dispute that, obviously.

Another issue from same employer /LOC not cancelled

Hi All,

Thanks for the help
Previous employer didnt cancelled my LOC (which I left/was terminated 6 month back) and hence
new company unable to request for new LOC.
I asked MOM and they said contact ur previous employer to cancel it.
The issue is it was termination of the employment and not sure what shall I ask previous employer

You should contact your previous employer and ask them to cancel your LoC, as MoM has directed you.

I emailed them and waiting for there response , however in this also it seems MOM is not keen on getting into it.they said request 3 times and then come to us ...

previously MOM had a process where employers fail to cancel LOC

essentially you write a letter to the employrer informing them to cancel the LOC, and copy MOM

after 30 days MOM considers due notice given / process followed and will proceed to cancel the LOC

the 30 days is to ensure the employers doesn't switch the story an say the employee did a runner.

They called me again and asked for address , I told them what is the link between these two.

They said this is the instruction from bosses.. :(

Send it via email and make sure you keep the sent message for MOM. Also sent it registered mail or via courier so you know that they received it.

maybe they want to serve you notice ;) ;)

there are some vengeful bosses out there but it also means what did you do to invoke their wrath

if the new employer cant wait too bad then ...

getting an LOC is a privilege ...

That was my immediate thought too. Which would put you in a catch-22, as any address you give (yours, a friends, etc) might then be considered a valid address for the purpose of serving Notice.
