IMHO he might have been charged under 354. (Assault or use of criminal force to a person with intent to outrage modesty) but this means he had to go beyond the words but not necessarily with any physical contact - showing his fist close to the other guy nose would probably sufficezzm9980 wrote:You can outrage someone's modesty by swearing?
