His rights end where he hits or even touches repeatedly someone with the bag. Unfortunately there is not much on the spot you can do with this. The best probably would be if the driver gives him an offer he could not refuse.

Yeah there is. I'd repeat exactly what I did last time and push his bag, including him attached to it away. If he decides to take it further, and get physical, it's assault and reportable to police. Usually they turn and just give you a greasy look and don't dare anything further.
