Retrenchment and Advertising the Job

Post by olivia242 » Mon, 19 Sep 2011 5:52 pm

Hi,

I was retrenched on the 9th September and told that my position was no longer required. However, I have just seen my position advertised on the internet with a date of the 8th September.

This means, I was still employed in the position while it was being advertised.

My job was managerial and I am wondering if I have any legal recourse against my employer.

Thanks.

Zip, zero, nada, none. Be thankful you weren't terminated with cause. That looks even worse on your record. Obviously there was not a good fit between you and the company. Not saying you weren't doing your job, just the the corporate fit might not have been what they thought they were getting.

I know it's not what you want to hear, but the facts are, you have no legal recourse whatsoever.
