Work Permit and LTVP matters

Hi, I am a SPR and my spouse is a PRC, she is holding WP and going to resign in coming March'11.
I obtained salary > S$2500 per month.
We have done our ROM in Singapore with MOM approval letter.

Here come the Question:

1) Must her go back to China after WP cancel? Is there any method to apply any VISA or PASS to stay in Singapore without going back to China?

2) If she went back, is there any minimum re-enter period for her? If yes, how long will be that?

3) What are the chances of getting SVP approved? If rejected, can appeal through Form 14A with personally go down to ICA?

4) I have no property in Singapore, does my salary enough to justify that i can support her livelihood here? Will it affect the process in applying LTVP?

I would not encourage you to ask her to resign until you can get confirmation that she can be on LTSVP after her WP is cancel in writing

Yes this is the min. guideline for sponsor

Once her WP is canceled she will be given a standard 30 days SVP . Not much time and things you can do within 30 days . You need to sponsor her when applying for her LTSVP NOW. Proof of income, marriage cert. Tax return are some of the doc that you need to supply. if you cannot get this done, I am afraid she will go back to China

This is matter of contention. Some guideline said she should return to her point of departure. Some states 5 days turns around. MHO 30 days turn around is a safe bet

SVP approval is no problem but to extend it is another matter. Yes go and appeal if you must personally . But I must state though MOM approves your marriage , that does not necessarily a green light for ICA to approve her LTSVP. Too many similar cases have occurred.

So, does it mean i can apply LTVP passed for her now with holding WP concurrently?

Once she get LTVP, is she need to immediately stop working and cancel her WP?

My friends has suggested me to apply LTVP while she has cancelled her WP, they said with WP, application for approval is harder.

Hope your can enlighten me.

To my knowledge this can be done. It is best to see ICA officer to confirm in writing. Previous practise may not be the same as now. I am basing from previous protocol

If approves , she can only hold one pass, if she is on LTSVP then her WP will be or must be canceled at MOM. ICA issues LTSVP , WP is from MOM

She will have to quit work before she can apply for LTVP. MOM will not issue LTVP while she is still on a WP as she is not allowed to work on an LTVP. Whether or not she can get the LTVP issued in the space of the 30 day SVP issued upon cancellation of her WP is another question. The SVP cannot be extended. (it can in normal instances) but not one that is issued as a result of cancellation or expiry of a work visa.

Your statement is saying MOM will not issue the LTVSP while on WP!

I was under the impression that ICA issue the LTVSP not MOM. I searched MOM website, LTVSP and found nothing. Link didn't open for me. The only other info was PEP and LTVSP.

Upon the cancellation of an employment pass or work permit, MOM directs ICA to issue a SVP. It used to be MOM would direct ICA to issue only a 14 day SVP for WP holders. She's now standardized it to 30 days across the board but ICA will not extend those SVPs and requires the individual to then leave the country by returning to their country of origin (WP holders) or at least out of the country for 5 days minimum (EP holders) but that is not in writing but seems to be the current practice.

On the other hand, if the SVP is issued by ICA as a normal issuance upon entry to the country, then it IS possible to get an extension. The reason it's difference is that once the WP or EP is cancelled, the worker is then an illegal immigrant. MOM has the authority to issue the SVP by ICA but only for the cancellation of the worker visa.
