Funny. OP started off inviting everyone's opinions, and then ended up abusing everyone because he didn't agree with what they had to say.

Fact is he has less than nil chance of getting the govt to somehow successfully sue his neighbour... but he won't listen. I think it fair to say you would have to be a 'couple of slices short of a full loaf' not to appreciate one's approximate position in such circumstances.

The OP has not even stated what the alleged heart condition is. Plenty of babies are born with heart conditions such as PFO's (hole-in-the-heart), there is no known connection re: passive smoking. The OPs daughter had heart surgery... so what... that in itself means nothing.

The OP seems to have come here (and why here?) for free help to successfully sue his neighbour, not to determine if he had any chance of doing so in the first place. No wonder he seems so irritated :-|
