LOC and EP

Post by jayashree_sound » Tue, 09 Nov 2010 9:30 am

Hi all

I know that an LOC is tightly coupled to the husband's EP.

Suppose one starts work on an LOC.

1)Is it possible to apply for an EP for the same position while working on the LOC?

2) If in case the husband decides on a change of employer. What happens to the LOC? How to handle this scenario?

Yes. If you are successful in getting the EP, your LOC will be canceled and you will no longer have a DP tied to your husband's EP, but will be an EP in your own right.

If your husband changes jobs, then his EP at his old job will be canceled, as will your DP, and therefore LOC. When the new company applies for his EP, they will also apply for your DP. Once you have it, you go back to the company you are working for and ask for another LOC.

One word of caution: Make sure your husband's new company will sponsor your DP. There have been posts on this forum where the company refused to sponsor the DP, creating all sorts of problems.

Thanks a ton.

So i can start working on an LOC.

If in case there is a possibility of my husband changing jobs , at that time I can apply for an EP (while my DP and LOC are still valid).

Once my EP is through I dont have to worry about my husband's EP. Am I getting it right?

What I am trying to ask is that there is no clause where if you have an LOC you should not apply for EP?

You have it correct. You could also apply for EP at the beginning of your job, that is, if both you and the company can qualify for an EP.
