Cancelling rental agreement

Hello all,

I have engaged myself into a tenancy agreement of 2 years lease period of which will take effect at 1 November 2010. I signed the tenancy agreement on 6 October 2010 and have change my mind on 7 October 2010 and want to cancel the agreement with immediate effect.

Can i cancel the agreement without getting myself into any charges? I have not paid any money to the agent or the owner yet.

I want to have a talk to the owner but yet the agent refuse to let me have the owner or the co broke number. If i cant cancel the agreement, is there alternative way that i can solve my case?

I couldnt turn to anybody as i have dont have a copy of the tenancy agreement etc(i do not read thorughly the termination clause so i do not know what i'm up against to as the owner wants to take legal action against me).

I can only turn to my agent but my agent is being uncooperative and he is the one who told me that the owner will be sue-ing me.

Btw, i didnt pay up anything yet. I didnt pass them any copy of my pass,address or documents.

Help please. I just dont wanna pay the agent fees and everything related to it.

Yes, you can . Based on the span between your signing and occupancy as you have not yet occupied the apartment at all. There is a law specified as "cooling off period" about one week. You do not have to pay the owner/agent anything at all

Although you do not have the TA with you. Make a paper trail between the LL , the agent and yourself. Register yourself with CASE to protect you from further harm.. No, the owner cannot take any legal action although you have signed the TA as you have not paid any monies nor occupied the apartment at all.Furthermore you have informed within a span of ONE day that you wish to cancel the TA.

The bloody agent is doing a fast one one you. Tell him to stick it up his a**hole. Do not pay anything to the agent, he can harrass you but just inform that you have register yourself with CASE. Relax. If you said what really happen face value here then you do not have to worry

Yes,i noe the blardy agent is freak giving me problem and headache.. pressurized me during the course of agreement.. i ady called CASE this morning to ask about it.. the person in the phone says that this cooling off period doesnt apply for rental agreement.. it applies to direct sales and another category but not rental agreement..

she say rental agreement is a legally binding contract of which i can only refer to the terms of termination in order to terminate the lease of which i most probally need to pay penalty..haisss.....

anybody can help me?or any idea?or can confirm any law area which i can void this agreement?i'm in a deep shit......i'm wondering if i get sued, and i no money to pay anything penalty or watsoeva..then what will i be sentenced to? jail? lolxx...hais....this stuff making me to have restless night this week...i couldnt turn to the owner cos i dont have his contact number and yet i also couldnt turn to my agent cos he refuse to giv me the landlord contact number or help me in anything..

oh god..help me pls..i will repent.. =-=

Calmly make a suggestion to your agent, that you have already taken legal advice and that if he doesn't cooperate then you will also take legal action to ensure he gets his licence revoked or a hefty fine and black listed. Its their choice. Call his bluff, by sending them a letter if you don't wish to face them.

Until the stamp duty is paid and therefore the tenancy agreement registered no court or authorities will recognize the agreement.

Just walk away and make sure you keep all correspondence whether SMS emails etc.

I dont think they are going to sue you. They still have enough time to rent out the apartment. In case they plan to sue you they will have to leave the apartment vacant which they wont do. Dont worry, since you havent paid any money you have nothing to lose.

I just curious, how come you dont have a copy of the rental agreement? I guess what you have signed is the letter of intent. Normally the LOI is signed first and you pay a deposit and then on the move in date you sign the agreement.

So I really dont think what you have signed is the tenancy agreement.
