Hi

I have been involved in a case ( theft under servant) which happened in later year, due to this crime, I have been fearing of getting a job as I'm worried that I might been attending court and serve my sentence in any moment. jobless for 5 month, without any income to settle my financial debts with banks, I cant suvice and found a job (contract based). recently I recieved a call from the cantonment Police div that my case has been finalise and ask me to head down to the cantonment Police. I know for sure that I will be attending the court and serve my sentence.The main concern now is I have to give one month notice to the company, otherwise I might need to pay for the one month penalty fee. due to my financial debts, Im bearly can afford to pay for this one month penalty

Anyone can advise, whats the normal procedure? Is it possible that court hearing can be postponing to later date where I dont need to pay for my company the 1 month clause?Anyone can recommend lawyer that doesnt charge high to present me for lighten sentence? I admit and plead guilty but I wish to have lighten sentence as Im married last year and I just got my flat which I ballot in 4 years ago.

You need to request a deferment, though I suspect it unlikely. Looks like your in for a tough ride for the next year, though keep positive.

What kind of work have you been doing, what kind of work can you do, how old are you? Do you have children yet? I'm just curious, and very sympathetic you are in this situation, crime never pays, there is always a payback eventually, so stay on the right side and don't lose faith in yourself. I do not quite understand your first post. You are jobless and being concern to terminate your employment contract?

I got a job after 5 months being jobless, I cant have no income , I need to repay my bank debts. Currently stuck in difficult situtation that I need to find ways to pay less for my termination of contract due to my court case, or is there a possibility to defer the court hearing so that I can serve my one month notice

What did the IO wrote on his report under what penal code?

You need to tell us when this occurred and when did the IO rang you for arraignment.

What is you debt amount. ? Are you a bankrupt now ? WHo restructure your debt.
OP.....You need to tell us in plain penguin as we are not mind reader. You have to come clean.If you cannot do that we cannot advise you. It will be your loss not ours.

the Penal code is 381. the finialise charges against me, I have yet to see.
I have commited this crime in October 2009.at that time I asked my IO whether is it possible to charge me immediately and let me serve my sentence rather than dragging my time, his answer is no, have to wait for the approval from ( I think its ACG or something like that).I have waited for 5 months for their answer and yet there is no news. I do not have a job, no income and at that time I have owed a total debt of 30 k (I'm not a bankrupt) I have arranged monthly installment from the banks on my own without any help from the CCS or any other organisation.
I cant possibly stay jobless and wait for their charges therefore I get a contract job in around April
The IO has rang me last friday,and its quite surprised to me that I have changed my new IO. I have made arrangement with previous IO that I need to find a job, get stable income to repay my debts (if not for my repayment debts, I wont commit such crime). This new IO has been hostile to me, indicating that she has been very nice to me, she call me since last wednesday but I didnt pick up the phone. Though I have a miss call, I try to call back but there isnt any answer, she didnt send me letter to my residential address, she didnt leave a voice message for me, she didnt sms me, how do I know she find me and cant reach me for 2 days.
I explain my situtation to her that I need time for my resignation notice period, she indicated that Sir, this case has been dragged very long and what do you expect to let it drag again? But this is not my fault that this case will be drag till now. I have been cooperative to them, I plead guilty and admit to those charges. Its their approval to charge me took so long.I'm not trying to escape the charges, what I want is to serve my contract notice without paying, thats simple.
Meanwhile I need to find a lawyer ( charges not too expensive) to assist me to plead for lighter sentence.any recommendation for lawyer?

Yeah Penal Code 381 is theft but what kind of theft has you done ? Is this your first time offence? What investigation do they carried out for you to wait for six month ? Theft is NOT a serious crime so again you confuse me. Do not mix the debt and with the offence.You do not need to wait for ACG to give green light. The PP will do this
