Consequences of Rejecting "Approved Employment Pass&quo

Post by kfang77 » Wed, 15 Sep 2010 10:16 am

Hi,

Please advice if you know anything about this.

I have a friend from forein country who is currently holding work permit in his existing company. He has got a new offer from new compony and the company applied employment pass for him. The employment pass has been approved by MOM but he may need to stay back with his old company due to some reasons. In this case, he got to reject the approved employment pass.

Is there any consequences of rejecting employment pass? Will he has problem when apply it again in future?

Please share if you have any similar stories.

Thanks in advance!

No problem at all. However, just because he had it approved this time, doesn't mean it will be approved the next time. Policies change. Or, it could be with a new employer who cannot support the need to hire a foreigner. It's not just dependent on the potential employee, but it's a two part approval. The employer has to also be approved to hire the foreigner after the foreigner is found suitable.

Hi,
I would like to add some more to this discussion. Actually my wife was holding Work permit and worked there for 2 months, after this she was offered official job from a new company and the pay was also higher than old one. For this, she had to resign from work and cancel her old work permit. Now the new work permit application from her new employer got rejected and now appeal is in process. My query now is, how would things be taken by MOM if she goes back to her old employer and her old employer apply work permit for her again. How would the chances be for the approval ? When current appeal letter is in progress can her old employer apply new work permit application for her ?
Waiting for reply from you guys.... Thank you

She will probably get caught up in the cracks like one did last year. Took forever to get it sorted out. She will need to withdraw the current application before starting a new application. Once she gets caught between the cracks, she'll have a devil of a time trying to get it sorted out. In theory it's supposed to be okay, but in practice it don't always work that way.

You should NEVER cancel your pass / resign your job until the new one has been approved. Better safe than sorry, right?

Quite right!

I misread the OP's initial post and thought only the application had been filed. I didn't know it had been approved. However, it's not clear if the new EP has been picked up or not. If it's not been issued, then they may well have to cancel the AIP before applying for a new EP.

Now, applications from both employers got rejected and like sms said she is squeezed now :( Both of the employers are willing to hire her but on Work Permit only, i don't know why MOM rejected the application from her previous employer. Now, her previous employer is appealing for her. What could be the solution to this problem ? I wonder why MOM doesn't enquire when doing pass cancellation. They know Work Permit has to be cancelled first before new employer can apply , still they reject. How can she get out of this mess and start working again ?
