Divorce Help

Post by Hedgehog » Sun, 25 Jul 2010 4:39 am

Hi
I am currently married to a Singaporean lady and we have 2 young boys under the age of 3. I do have permanent citizenship. Who are the courts likely to award custody to? Her family are in Singapore - mother, sister & brother. My family are in the UK? Am I able to take the boys out of Singapore?
Any advise would be gratefully received!

If she is a citizen and you are a PR and the children were born here, then they are Singapore Citizens. The odds are custody of the boys (especially considering Singapore's NS minefield) would be to the mother.

However, that is purely speculation and I would suggest you call a lawyer for better legal clarification.

Under the SG Family Law, the custodial right of care and concern on child lies on the mother/wife. You have to proof that she is incapable in the Family Court or she requested that to release the care of the child to you.
NS issues is another thing as SMS has mentioned. There is no extradition agreement between SG and UK on divorce matter
If you are married under civil law, child maintenance if cared given to the mother will befall on you as directed by the court.
Since you are a SPR. you renewal will be an issue if you leave for UK permanently as it is seen as marriage of convenience based on the age of the child. This is what I gather from the ground
