Could someone help me the legal angle for a case where an employee absconds from a company where he was working in an EP? What are the comlications? How will this affect the future?

If the guy was on a EP and he left the country without the IR-21 (IRAS Tax Clearance) being filed, then he has broken the law and should he return to Singapore in the future, there is a strong likelihood that he will be picked up for tax evasion as his particulars would be flagged by IRAS throughout the various ministries including Immigration and MOM. It's also debatable if he would ever be allowed to work in Singapore again.

This is the Act

Termination of employment of foreign employees
9. —(1) Where the Controller has decided to suspend or revoke the work pass of a foreign employee under section 7(4), the Controller shall notify the employer of the foreign employee of his decision and the employer of the foreign employee shall, within 7 days of receiving the notification, terminate the employment of the foreign employee.[30/2007]

(2) Every employer of a foreign employee who intends to have the work pass of the foreign employee cancelled shall —

(a) apply to the Controller to cancel the work pass; and

(b) if so required, return the work pass to the Controller within 7 days of such cancellation.[30/2007]

(3) An employer who contravenes subsection (1) or (2) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000.[30/2007


What it does means is if you abscond, the employer has 7 days to cancel your pass, from then on, IRA SG will be inform of unpaid tax due on to you and ICA will be notified of this offense and subsequent cancelation of your EP Pass. The employer would not want to take the rap of your misdemenour.
Re applying or entering SG border again will result in you being flagged

If you are having issues, work it out with your employer like a mature adult. Most employers are willing to end things amicably.
