So I got a call this morning from the 'Legal Manager' at ERA Realty asking me for details after the landlord went ahead and lodged a complaint with them about their agent. The email he gave me is a persing.com.sg email address so I think it's legit as persing are the parent company of ERA.
So I've just mailed off all the details to him (I could just have pointed him at this thread I think

) with the dates, amounts involved and everything else inbetween, along with attachments of the begging commission emails from the agent that were the reason I started this thread in the first place. ERA have promised to investigate and come back to us soon. I told the legal manager on the phone that we would be filing a police report in the next few days if this doesn't get sorted out and he said he totally understands but hopes he can get it sorted out before that is required, so we'll wait and see I guess

the TA started was 15th dec 2009 we only got to move in 27th dec...the contract says the landlord cannot terminate the contract during 6 mos. period. but the lease is 1 yr. no stamp duty also this is an hdb unit.. but that was a very stressful time to us but we decided to move in anyway because we had paid 6 mos. advance because of the landlord's offer to lower the rent. During our initial 2 days in the house the landlord was already showing the flat to people for selling..and i asked the agent bout it and she said the owner have the right to do it.
so today we found a new hdb unit under EMS with a contract and stamp duty.but there was administrative fee on top of the agent commission. but i decided to get the agent's IC no and delayed his agent commission until we move in.
i hope this time no more stress
but i noticed in ads nowadays specially in HDB that the owners are asking for 1 mo dep + 3 mos adv. or sometimes i also encountered 1 yr advance...is that even allowed .how can the tenant have any protection if there is cheating.

also about the police? i went there during the time that we couldn't move in and complained but the police told me its not cheating and we should file our complaint to small claims court...but did mention not to inform the small claims court that it was their suggestion.

Another update.
After I sent all the info off to the legal guy at the agency they spent a few days investigating and then went back to the landlord and told him there was nothing they could do! So he basically threatened them with the police if they didn't sort it out by the end of the day. He put together a document for the police and asked me to review it for him, so we were on the verge of doing it.
Lo-and-behind later in the day they found the agent and agreed to pay the landlord the money the next day, that was yesterday and the landlord now has his money so all's well that ends well I suppose.
The legal manager apologised for the conduct of his agent which is fair enough, however I would never use that agency again as it seems to be like they only paid up at the end when threatened with police/legal action.

Thought I would give an update on this.
We've been moved in for almost a month now and all is fine, the landlord has been very accommodating with any requests we've had and we're happy.
He's left ERA (I found this out when I contacted them to ask for the copy of the stamp duty which we hadn't received, I can only speculate on why he doesn't work there anymore

) but is now working for OrangeTee and has adverts up all over usual
property websites.
Just wanted to give this update as a warning to anyone thinking of dealing with him as he is working for a new company now
