Working for Singapore company while living in Kuala Lumpur

Post by deepak25978 » Wed, 06 Jan 2010 6:50 pm

I am an Indian citizen with Australian Permanent Resident status (same for my wife). I currently work for HP Australia. I have a permanent job-offer from HP Malaysia in Kuala Lumpur and am planning to start the paper-work to get an employment pass for myself, sponsored by HP Malaysia. We intend to get a ‘dependent pass’ for my wife.

My wife is a Australian Solicitor and works for Skillsoft Australia. Skillsoft is happy for her to continue with her current job (Legal Manager, Asia Pacific) and ‘work-from-home’ in Kuala Lumpur, as Skillsoft does not have any legal entity / office in Malaysia. Skillsoft does have a legal entity in Singapore and she will be employed by Skillsoft Singapore with a registered office in Singapore.
Questions: -
1. Does the ‘Dependent pass’ allow my wife to ‘work-from-home’ in Malaysia, while being an employee of Skillsoft Singapore with a registered office in Singapore ?
2. If the answer to #1 above is no, is there any alternate visa that we can apply for my wife ?

As she will be earning her income outside of Singapore, as well as living outside of Singapore, she needs no visa for Singapore at all. Doesn't matter where the company is, it's where the work is performed.

As for a the visa situation in Malaysia goes, I cannot help you with that one. Maybe Vaucluse might have an idea if he sees this post as he is living in KL as well.

Thanks sundaymorningstaple.

Is there anyone who can provide some thoughts on the Malaysian visa status and with special emphasis on how to get a work visa for Malaysia without having a registered office in Malaysia......thanks !!!

She won't get a work permit for Malaysia since she will not be employed by a Malaysian based company.

The best is she lives off a Dependants Pass in Malaysia and keeps her head down. The benefit in addition is she won't have to pay taxes in Singapore as she spends most of her time out of the country.

She won't have to pay tax in Malaysia either because a) her money is earned outside of Malaysia and b) she's not employed by a Malaysian company.

I know a few people working off similar lines up there.
