Is downloading of software from rapidshare.com is illegal?

Oh, it's a hell of a lot more complicated than that... but the short answer is, as long as you're not using somebody's likeness with a commercial motive that implies they're endorsing whatever it is that you're selling, you can publish the image. If the image was taken in a public place and the person is peripheral, you don't even need their permission to take the photo in the first place.

yes rapidshare and megaupload is legal sites, but the content is the user uploading and downloading responsibility. so be careful with what you are downloading

Just out of curiosity, has anyone ever known/heard of anyone being arrested/fined for using rapidshare?
