PR Application

I am planning to apply for PR by this year. Im no longer with my husband but we have a kid. Can I NOT apply my husband as dependent? Because I DONT want him to be my dependent when i apply for my PR. I will be applying for my son only.

Also, do I need to get a consent from him if I'll be applying our son as my dependent or will our marriage contract suffice for it already?

thanks..

Hi Audrey,

you can certainly apply for yourself and your son (should your husband agree) without your husband being a dependant.

Regarding the marriage contract/whether you can apply without your husbands consent for your son, I wouldn't rely on guesses. Ff you are serious about applying you should speak to a lawyer.

So you mean I need to get a consent from my husband for my son's application?

You might need to if you have shared custody. Thus you should discuss this with a lawyer, not in a forum as this might come down to a court ruling in the extreme case.

Hi Frankey,

average processing time is three months, so you should hear back from them soon. If you already are a PR though and your wife doesn't have any bad records then she shouldn't have any problems getting PR. Best thing is to be patient and not worry until you hear from them.

thanks

If you are divorce and your current DP is gotten via your HB, then your DP will need to be revoked.

In regards to you applying for PR, if you are a divorcee, the PR application will be based on you qualifying to be granted PR status!

If you are separated from your HB, and you have legally apply for separation via your lawyer, then, if you apply PR status without declaring your current status now, you wud probably contravene the immigration act of providing false information. Penalty will be fine or jail or both! afterwhich, you will be repatriated!

Flw, if you are divorce, it is unlikely you can apply for PR if you are currently not on PR status, but on DP status! You will not be qualify to apply for PR!

If you receive a reply from ICA within 2 months, it is unlikely your PR application is approved. The good bet period would be 90days - 110 days :-|

Thanks for the heads up Starbucke. That is a good guideline if correct.

I got my PR in 1 month, it seems to depend more on which country you're from.

True, but my wife did it in about the same time a year earlier on her own, and she's asian. Care to guess which ethnicity
