Transferring into another company

Post by ghozzg » Mon, 28 Jul 2008 10:13 pm

HI,

I've went here in singapore last june 10, like any others I was also seeking job opportunities here. I had a job offer and accepted it eagerly. I started working even if I dont have the pass (it is indicated in the job offer that I have signed that I will be working as trainee while I'm still waiting for the processing and approval of my pass, it is also indicated there that I will have a bond for 1 year and if I will leave the company during that time frame I will pay 2x of my monthly salary, the start of my bond will be also the comencement of my pass approval). Now, I've in that company for 1 month already and dont have the s-pass yet. My hr officer told me that it was rejected and that they would make an appeal for it. Can I transfer into another company? I have entertain a lot of phone call interviews and planning to transfer. Please help me on this matter.

Social visit pass (SVP), it suppose to expire last july 24 but I apply for the extension and it was approved (have already inform hr about it). So I still have 30 days more for the company to fix my s-pass or to transfer into another company, if possible.

Are they paying you at the moment?

I don't want to worry you but I think you might be working illegally!

yes they are paying me... what do I need to do? I do not want to be in this position, all I want is to have a job and the proper documents needed for me to work legally.

Not too sure what to recommend as I pretty sure it's strickly prohibited to work in Singapore while only holding a SVP?

Maybe SMS will be able to shed some more light on your situation as this is his field of expertise

It's not a transfer. It means you are persuing another job. This will mean you have to start the S pass application all over from scratch with the new employer applying for it. If it's also rejected then your additional month visa will be close to being finished and it's doubtful whether ICA will give you another one.

It seems like it took a long time to find out you were rejected. That or HR just didn't bother to tell you.......

I started there last june 10, and hr told me that they apply for my pass the soonest possible time. after a week I've send them email for verification and told me that it is still under process. the following week I verified it again, but same answer.. the 3rd I've send them email 2x but still same answer. on the 4th I was still the one to send them the email and they respond and said that it was rejected and that they would make an appeal, so what I did is to apply for the extension of my social visit pass so I can stay here legally. I'm so worried of my situation, I've spent sleepless nights on this problem of mind. any suggestion or help, would be very much appreciated.

If your pass is the LTSVP you can apply to work, you must not take up employment before getting the approval letter.

You have been turned down for the S pass because you don't really need it, all you need is the approval letter to work. The LTSVP is renewable every 6 month. If you are on a Short Term VP you are not allowed to work that i know of.

You have been rejected probably because the company employing you should not have employed you, until approval by letter from MOM that the person may seek employment.

You the person must approach MOM for the work approval letter, then find the job, the company will endorse the letter, and that's it...Much of it depends why you are on STVP in the first place. But again short term visitors pass not allowed to work, unless you are a direct dependant of a spouse or family here.

An application for S pass is independent of STVP, and would probably be rejected if you have no dependants here too. because you are not allowed to seek work on STVP without prior permission from MOM. No short cuts in bureaucracy

ksl,

you've got it bass ackwards.

You cannot work on a LTSVP nor can you apply for a letter of consent on an LTSVP. You have to be on a dependents pass to do that. As he is on a social visit pass he has to apply for the relevant visa.

Dependent's Pass

As far as working on the SVP, saint is correct as it is illegal although it is done all the time by most companies while the Visa is being processed. If he is applying for a work permit, normally it's pretty straightforward and if you file online MOM will generally give an instant "Temporary Work Permit" to allow the worker to start immediately. This is not the case for "S" passes or EP's but I do know that most companies put them to work anyway and pay them cash or dayrate as subcontract labour (illegal also).

I'm not sure why it's taken so long to find out that it was rejected as it's usually no more than a two week process unless the employer is just pulling a fast one. (There are those who do that).

I believe, if I were the poster, I would make a trip down to MOM to do a check as to when the application was filed and why it was rejected (probably will not get an answer to the second though).

Thank you very much for your replies. One thing more I've also learned that it was filed 2 weeks after I started working, I was able to find out tru my friend who check it online. meaning it was filed very very late, and unfortunately it was rejected. I think that was the normal practice in that company that while their working pass is under process, they will let the guy to work. Just like in my case.
