Employment Pass chances with prior conviction

Post by bigpine » Thu, 01 Jun 2006 9:18 am

I am planning on an expat assignment beginning in August. I have a nice position to look forward to. Everything was looking great until I completed the Employment Pass application (P1 category). Section IV of the application asks if I have any previous convictions. Well 4 years ago I was convicted of a Driving Under the Influence of alcohol. In my state in the USA this is categorized as a serious misdemeanor. It was a really stupid mistake on my part. However, it was an isolated incident and I've had no other convictions before or after this single event. Does anyone know if this will seriously jeopardize my chances of getting the employment pass? I contacted the Ministry of Manpower but they would not give any answer just that each case is evaluated individually. I already submitted my application.

It is doubtful that it will have any real effect. They are looking for criminal records, a misdemeanor is still a misdemeanor. I've gone through EP's and PR with a DUI from Louisiana with no problem, wasn't even asked about it. It's a traffic violation unless you plough down a bunch of people or create havoc.

That said, you are correct insomuch as they treat each case on it's individual merit. I wouldn't worry too much if it's a P1 your are applying for.

Thanks for the replies! I was curious did you note your DUI from Louisiana on your EP application? Or did you leave it off and they never checked?

To be totally honest, I really don't know as that was 20 years ago. and over 15 years ago when I applied for my PR. I would be inclined to think I did as I though that they might check up on it as it was only 2 years prior to coming to Singapore. Unfortunately, I don't have copies of the original applications to check. But at the end of the day, as another poster said, Honesty is the best policy.

Bigpine did you get your P1 ok? I'm interested as in a very similar situation, albeit 8 years ago. Thanks.

regarding applying for pr

Post by question » Mon, 02 Apr 2007 3:24 am

hi
planning to apply for pr.
i had my previous visa revoked( not for criminal reasons ) but just that
i did not qualify for that visa since my wife did not qualify for that type visa(under that visa both should qualify for that visa)
in the app for pr they have asked , have you refused entry to any country
does that mean visa rejection/visa revokation
can anyone clarify ?
will this in any way effect the decision they take ? has anyone had the similar situation ?
regards
question

You have not indicated if you were deported out of the country or not. If your visa was changed from one type to another then I would have to say no. However, if you visa was cancelled and you were immediately escorted to the boarder then yes you could say you were refused a visa or entry. A downgrade is not the same as refusal to enter or being deported.

re : visa rejection

Post by question » Mon, 02 Apr 2007 7:00 pm

No i was not deported , thats for sure and nor was i taken to border etc.

while i was applying for the visa for my wife ( from a another country to the country where i want to goto), the visa authorities rejected visa for my wife saying that she did not qualify for that type of visa

since in that type of visa both husband and wife should qualify , my visa ( which was issued before my marriage ) was revoked

and mainly this does not mean that we are compeletely forbidden to enter that country but only that we did not qualify for that type of visa.

i presume that for the question "have you ever been refused entry into" i can say no isnt it?
i m sure that i was not deported so it is obvious for me to say no for that.

but only "refused entry" is a bit confusing , does it mean refused visa or something else !!!

regards
