I am not sure if my situation is complex but I'm hoping for some advice. Wanted to do some planning before we decide to move over.
- Me: Female, SC, 33 years old, currently residing in Australia
- Spouse: Male, Australian Citizen, 34 years old, currently residing in Australia
- We are both legally married, registered in Singapore, about 2 years now.
- He has 2 children aged 13 and 11 from previous marriage, both Australian citizens, making them my stepchildren.
- I am expecting my first child (boy) in April 2025 with my spouse.
- We plan to move back to Singapore somewhere later after birth, all 4 of us plus the newborn.
- We are both currently working full-time permanent jobs here in Sydney. I earn 85k/annum and he earns 65k/annum. He is not an expat, just a simple guy doing labour jobs here with basic education. It's pretty norm here, unlike in SG.
Here is where it gets tricky:
1) I am unsure about the legal documents we require to bring over his children when we move. They are from his first partner, separated for perhaps 8 years now? She isn't present much in the children's life. Since they are 11 and 13, I assume there should be some sort of court order or perhaps biological mom approval to move? Quite clueless on this part. The kids are keen on moving too, by choice.
2) He also has a criminal record 10 years ago got off with a fine and good behaviour bond. A DV case, self-defense but unfortunately still got charged for it. I read all the court papers on it before marrying him cos I am kiasu lol. <Please no judgment here, we've dealt enough with that...
Will this affect his chances of getting LTVP and PR?
3) I will give birth in Australia, and later register my son as SC. Will it mean my kid will have dual citizenship? I believe it's only till 21 years old or till NS i think. My stepson is dreading NS but I know he will enjoy it hahaha
I will probably stay with my parents for a short while before applying for a home.
