spouse sponsored passes

Post by Mick2112 » Mon, 05 Feb 2024 11:56 am

Hello, I've been quietly observing and reading through some of the discussions here, and I have a question about the spouse scheme.

I've been a PR for over 15 years now. I've noticed several topics related to PR. I obtained my PR status through my wife who is local Chinese. No kids.

I have a broad question about spouse sponsored passes and I hope I won't be criticized for asking this, as I couldn't find an answer online.

Suppose my marriage ends for any reason, and I'm still a PR at that time, I understand that my PR status won't be renewed but I can retain my original country's citizenship. However, if I apply for Singaporean citizenship through spouse sponsorship, I would have to renounce my original country's citizenship. So, if something were to go wrong down the line, let's say in 10-20 years (just speculating here), and we end up filing for divorce or something similar, what would happen to my Singaporean citizenship? It doesn't seem logical for the government to revoke my Singaporean citizenship just because I applied through my wife. If they do, what would happen to my nationality?

Not trolling; this is a genuine question :o

First of all, PR doesn't expire, the REP does. I've not heard of any spouse-sponsored PR being revoked or REP not renewed solely on the sponsor not being in the picture anymore. It may happen in combination with other circumstances (like residing overseas for a long time and rarely coming to SG). I've never put it to the test though, so I don't know with 100% certainty.

As for citizenship, that can only be revoked under very specific conditions as spelt out in the SG constitution (see part 10 on citizenship), which is a good document for all aspiring SCs to read.

Thank you for your response. I'm not concerned about the REP. The constitution doesn't mention anything about sponsorship and divorce, among other things. Let's assume that there are no other factors in my profile that could lead to revocation. For instance, I'm residing in Singapore without any issues with the government, etc. However, if we unfortunately have to file for separation, this shouldn't affect my Singaporean citizenship status just because I'm separated from my sponsor, correct?

I'm not trying to debate about the constitution or anything else this is purely for general knowledge.

Q: Will my PR status be revoked if I divorce my spouse who sponsored my Singapore Permanent Residence (PR) application?

Ans: Any cancellation of PR must be done in accordance with the provisions of the Immigration Act (Chapter 133) or the Regulations thereunder. While your PR may be sponsored by your spouse, your renewal of REP will be assessed on your own merits if you are divorced or under-going divorce.

Naturalised citizens may also be stripped of citizenship for: fraduently acquiring it, committing an act of disloyalty against the state, aiding an enemy nation with which Singapore is at war, serving in any capacity for a foreign government, being sentenced to incarceration for longer than 12 months in any jurisdiction or fined US$5,000 for any offence within five years of acquiring citizenship

https://www.todayonline.com/singapore/c ... awyers-say

The MHA told TODAY that 1987 was the last time it took away the citizenship of a naturalised citizen because the person engaged in activities that went against “the interests of Singapore’s public safety, peace and good order”. He had committed various serious offences including drug trafficking, it said without identifying the person.

Once a decision is made to invalidate the citizenship, the person would be served a notice and has 21 days to file an appeal. He will remain a citizen throughout the appeal process, which will be referred to a Citizenship Committee of Inquiry.

If the appeal is denied, or if the person does not file an appeal within 21 days, he would lose citizenship and be rendered stateless.
