Lease Takeover (HDB, Malaysian Tenant, Hougang) - Questions about Process/Penalties?

Lease Takeover (HDB, Malaysian Tenant, Hougang) - Questions about Process/Penalties?

Hi all, seeking some advice.

I'm currently renting a 4bdr (i.e. 3 bedrooms + 1 living room) HDB near Hougang of almost 1000sqft for $3300/mth. I'm only 7 months into a 2 year lease but I would like to break lease. Reason? I'm usually not in Singapore.. I estimate since I started the lease, I've been away for 60% of the time, so it's honestly quite a waste of money and I don't see my scenario changing in the foreseeable future.

As far as I understand, the process is that:
  • I need to find a tenant to takeover
  • The landlord needs to agree to the tenant
  • [HDB Specific] If the tenant is a non-Malaysian foreigner, the HDB area I'm renting in cannot have exceeded the "foreigner quota" (I dunno the exact term - but those of you who know will know)
I want to ask if my understanding is correct, and whether I will incur any fees.

If I was already 1 year into my lease, I understand I could potentially exercise the diplomatic clause if I was leaving Singapore (i.e. resigning, getting laid off) - but I'm actually not - I am still employed in Singapore, but I've just been (sneakily) working remotely for the majority of the time..

Hi, thanks for your response. Is there anything else I should be aware of? Is there a chance my agent and/or landlord could refuse my request, thus locking me in until at least I am able to exercise the diplomatic clause?

Don't try to decode ALL 101 scenarios. Better sound it off to your landlord via your agent and see the response. That's the best option. But theoretically your landlord can say no and make you to follow the signed contract.
