Is the wall cracks and balcony water stains wear and tear ?

Hi
Soon to change apartments and recently our landlord came and did a pictures of the unit.
After that we did get a quote for wall cracks and stains in the balcony (it is a balcony open which gets rain on the floor and walls hence stains over time!)which we think should be considered as wear and tear, not our responsibility to pay and renew it after 5 years of living in the unit.
