Do i need to pay 1 monh's salary if i cancel my EP application

Do i need to pay 1 monh's salary if i cancel my EP application

Company A applied a working pass for me for a permanent position. But the pass is pending for 6 weeks already.

Now, Company B offered me a job and I want to go with them.

The problem is, in Company A's contract, there is a clause that says:
"Upon written acceptance, should Employee wishes to terminate this contract anytime before the actual commencement of work, the compensation due to the Employer is 1 month's basic salary."

If I cancel my EP application from Company A, am I liable to this amount? Even though pass is still not approved or pending for 6 weeks.

Contracts for Foreign Employees are not valid until such time as the relevant pass has been issued. They can try, but just tell the employer if they insist, that you will go to the MOM court for resolution. And yes, there is a court at MOM. Actually there are four courtrooms there.
