Flight cancelled; have to take more expensive flight. Who pays?

Post by martincymru » Mon, 23 Mar 2020 1:55 pm

23 Mar 2020

Scenario (not fact)

Short term pass expires 01 April.

Emirates to UK flight booked paid (01 Feb); flight 31 Mar was cancelled 22 Mar.
Sg Airlines have flight to UK (all dates up to 31 Mar) at 3000 sgd (Emirates was 1000 sgd; no refund).

To: ICA - "extend my visa 'cos I don't have 3000 sgd."
To: Br Consulate - "pay for the Sg flight or repatriate me at your cost."

Whats is the legal position / rights ?

If you literally can't pay Singapore will most likely deport you at the Singapore's cost and attempt t recover it but you would never be able to come back to Singapore.
I not lawyer/teacher/CPA.
You've been arrested? Law Society of Singapore can provide referrals.
You want an International School job? School website or http://www.ISS.edu
Your rugrat needs a School? Avoid for profit schools
You need Tax advice? Ask a CPA
You ran away without doing NS? Shame on you!

Probably you will have to pay everything by yourself.
Even under ultra-socialistic EU law and a flight under the EU jurisdiction the carrier will unlikely need to compensate anything as the circumstances are extraordinary.

So x9200, your opinion is tourist is forced by law to pay 20,000 sgd (I exaggerate but you get my point) for alternative flight thro' not fault of his own?

I am pretty sure the ticket T&Cs cover this sort of problems (voiding liability of the carrier) so at the end of the day it boils down to some bad luck. Unfortunately, unless one is insured, for bad luck one typically has to pay by himself.

If the delay is the result of the fault of the airline, the ethical thing to do would be to honor the original price paid. However, like one of the previous replies have mentioned, many carriers are very unscrupulous, and write into the terms and conditions clauses that void them of all responsibility, so its really hard to tell.
