Hi guys!!!
Good day. I just want to hear your comment/s or suggestion/s. I am an Spass holder and this is my second employer here in Sg. I already have a total of 3 years and 4 months of working here iN Sg. Now, after working for 1 year and 2months in my second employer, I got an offer from another company but the problem is they cannot hire me as they do not have quota. So they ask an agency to hire me instead. The agency apply my pass last Dec 18 2019 but after 3 weeks of pending status unfortunately it got rejected. They apply for an appeal last Jan 10 2020 and yet upto now no result yet. The agency told me that they find out the reason for my rejection but they dont discuss it to me specifically. However, do you have any idea how long does an appeal takes place? And any idea of its current success rate? There should be no problem for me waiting for the result as I am currently employed, but just this Friday (Jan 31,2020) my current employee just give me notice of terminating my employment as they got no more projects. Yes, they use termination instead of retrenchment to avoid retrenchment package something. Many of us got it. So instead of taking this termination I just resign and my last day would be feb 28. What do you think guys? I hope the appeal got successful and the result come up before feb 28. Haha please share your opinion regarding my situation. Thanks

Unless you know what the rejection was for, appealing is a waste of time. In fact, most appeals even when you do know, are a waste of time. What pass did they apply for? Work Permit or S pass. Quota's are very tight on S passes and the agency, if the are also acting as bodyshop seconding staff to their clients, they may be over quota and that's why they don't want to divulge the reason. Not too much you can do.
I guess when you gamble, sometimes you lose and get burned.

I do not really gamble coz I know sooner or later retrenchment will come in my current company. It just happen too early than expected.
It is an Spass. The agency did not divulge the reason, though if they know there's small chance for it to get approved, I dont understand why would they still take the risk and waste both of our time. Whereas the hiring company can easily find another agent atleast.

Probably a low markup compared to other bodyshops. Don't forget, when the bodyshop is carrying your work pass, they need to have a profit margin every month off your quoted salary. That is what they charge to their client. If they cut too close to the wire, they also lose money possibly.

Hi. Thanks for your reply. Agent told me the reason for rejection is "designation allocated", though she did not really specify the exact words from MOM. Do you have any idea about it?

Your title and your qualifications & experience possibly do not agree or the position is one that is not allows for foreigners (no, I do not have a list of all of them, but there are a few). Other than that, it would be better to see in print the actual rejection from MOM instead of some idiot junior HR clerk paraphrasing it into singlish so no English speaking person can figure it out.

Hahaha savage remarks to the agent

Does it mean it pertains to my new position I am applying? Though when I sign the contract my position is the same as my current one. Or can it be discrepancy in the previous job title?
I message the agent regarding the rejection advisory, I dunno wether she will provide. Is it my right to see the rejection advisory? Or is it their decision to share it to me or not.
Btw, Thanks for taking time answering my queries.

Technically they do not have to show or tell you, but unless it's their fault then normally would. Or, at least I always let them know, but I didn't pass that 'duty' to an underling of mine as I was the HR & Finance Manager and it was always my signature on the forms even it my clerk did the filing. So I owned it and would always tell them as much as I knew, which honestly, sometime was not too much as MOM tends to hold their cards close to their chests, if you understand what I mean.

I see. Ill get back how the outcome would be. It's been more than 3 weeks since the appeal and my length of stay here in Singapore is running out. Im now looking for other employer that will give me an offer. Hopefully, a new blessing will come.

Based on my experience, I applied for a position through a recruitment agency job posting and did round of interviews with the client company etc. Client compnay approved and they tried to apply SPass for me.
It was rejected due to the SPass issued under the recruitment agency instead of the company I will be working for. So MOM wants the SPass to be issued under the company that you will be working at, not under an agency.
Not necessarily. The recruitment company may have been out of quota or had a bad rep with MOM for shady practices. I used to be a technical recruiter before I became the HR & Finance Mgr 15 years ago. I had types in IT and O&G out on the Island. I was split about 50:50 between S & EP holders. But we had to be careful not to over reach our S pass quotas as when you ride too close to the max, if your local staffing falls too low, you can be over your quota and you won't be able to put anymore staff seconded to clients.

Haha thanks for your reply guys. As of now I have not heard anything yet about my appealed Spass. I also got another offer just this morning and accepted. I am not sure whether they will know I have pending application. Nevertheless, If ever they found out I will definitely choose this new employer coz it is a direct hire. I hope they apply the pass for me tomorrow so I find out if it is possible to have two pending application at the same time

You have to approach your previous potential employer and ask them to withdraw the appeal.

I already called them today and they say they already withdraw it. However, when I check it in the EP online it is still there. How long do you think withdrawal takes place?
Thank you.
