Landlord refuses to transfer back the Security Deposit and giving extra bills from unit renovation

one fine day suddenly, Landlord asked us to leave the unit (giving a 20 days notice) for not keeping the unit clean and he claims that its a ITS A BREACH OF CONTRACT ( the unit wasn't that bad as they are exaggerating)


Coming to not keeping the unit clean :

We had cooked the previous night of the day we asked the landlord to come fix the faulty air-con.
He came with his wife and found the unwashed utensils. and the unit was a bit dusty as we haven't cleaned that week as we had a peak week at work.

We agreed to move if he insists so, we moved on a verbal agreement of landlord paying us back the deposit within in a month deducting cleaning charges. Sounded fair to us too.

After a month we texted in the group claiming our security deposit, deducting the cleaning charges.
Now landlord is claiming that security deposit is completely forfeited against nothing, but FORFEITED.

And he is asking another 2090$ which includes bills of painting the unit, the paints were intact when we left ( Have a video of the unit 3 days before we left).
He has done a renovation of the unit and claiming that money as damage fixing cost from us.

Landlord has never given a contract termination letter to us till now despite of asking for it many times verbally. nor he had highlighted any damages or we have agreed upon to pay for it ,until we got back to landlord claiming our security deposit money.


Please please please help us out here with your suggestions and legal points to go against this injustice.

Take the LL to the Small Claims Tribunal for return of the deposit and to stop the claim.

You can counter claim the costs of moving and setting up a new lease if the LL did not give you adequate notice as per the TA.

Landlord did not give adequate time as per TA claiming that its a breach of contract( don't know where in the world not cleaning utensils can be considered as so)

and we had gone through a lot of hustle physically and mentally to find new unit a set a new lease. So much money we spend over it.

Later LL came us to us again asked to continue if we wants, before we leave the place.
and they were saying like, the contract of the place where LL was living is about to end.
So we need to move within 20 days

Well you still have a chance to get back the deposit. The SCT process is quite easy.
