EP Got rejected due to error on application

Post by Danial35 » Sun, 06 Oct 2019 10:05 pm

Hello guys, I hope someone can help me about my issue or had a similar situation in the past..

Here is my story:

I am a graduate civil engineer and was offered a job as a fresh graduate engineer. Signed a contract, filled the EP application and waited almost 3 weeks. My application was rejected but other applicants (3 more candidates who also got hired) they all got approved.
The HR told me it is rejected due to your nationality and age and nothing we can do.

I called MOM several times last week and finally one lady helped me and said it is not related to your nationality but at the time of your application, the company/HR has filed 5 years relevant experience for you and there is a miss-match of salary and relevant experience.
I explained to the MOM officer that I worked 5 years in construction mainly general works aka painting/landscaping, etc to save some money to go to university and it is irrelevant to civil engineering or any engineering industry.
She advised to file an appeal and have the company call MOM to discuss about the issue and amend it.
HR did not agree with me and said they are trying to be nice to you..After contracting MOM again they confirmed that this is the reason for rejection.
Following day, I directly went to the company and ask for the manager, met the manager and she heard and agreed to call and file an appeal. ( I think the HR made this mistake and did not want ti be responsible...)

I called MoM and they confirmed that the company filed an appeal.
Any one had similar experience? Can someone please help me or advise me about my chances? 🤦🏻‍♂️

Based only on what you have written, I anticipate that the rejection will be upheld as you have no relevant experience. Why should MOM allow a foreign fresher to take a job that any local fresher Civil Engineer can do. You are supposed to be bringing expertise to the country, but you are only bring a piece of paper that basically only says you know how to cram for tests. That's why you usually need at least 2 years of relevant experience. And the salary must be commensurate with the position and the experience (which is required).

As sound as rude you are , I will try to reply you politely.

You may read the post again, as clearly said other 3 applicants have gotten approved.
The paper/crap that you are referring is called an engineer degree where you are not familiar what it means so no point of explanation.
And yes believe it as it hurts, there are skills and criteria that a company look for which can not find or may find more potential in foreigners..

Anyways I look forward for someone with polite response and similar experience

Dont take it in the wrong way. As a fresher to get EP in Singapore is not going to be easy. There may be some cases where it will be possible, but not for ALL.

Did you try the self assessment tool? What was the result?

Actually On SAT i only can get S pass but this company was too stubborn for EP so they don't pay the fees. Now I'm stuck! I lost a job in UAE who is responsible for it?
Can I sue the company?

You cant sue the company.

1. MOM wont reveal to employee on the rejection reason
2. The employer in the offer letter, would have mentioned that the offer is valid, only if the EP or working visa gets approved.

If on SAT you can get only S Pass, there is no way that MOM is going to approve EP. But FYI, there are ppl who get EP based on SAT, even then MOM still has their own reasons which they wont reveal and reject them.

SAT is a tool at a high level to see if you will roughly qualify for EP/S Pass. But each actual EP application takes in more information like which past employers you worked, etc, previous salary etc.

So,in short, your chance to succeed in appeal, wont be easy.

No but at this stage I was able to speak to find out from the MoM by calling them as I have stated in my first post above.
The officer emailed me also today and said base on the SAT I am not eligible.

The offer letter does not say what kind of a pass it only says subject to approval of a work permit from the MoM ..

Lesson to learn: Never quit your existing job until you know 100 percent that you work permit will be approved.

What are you going to sue for? That you quit your job before you knew that MoM would approve your work permit? That won't fly.

What I meant to say is, as long as your Work pass is not approved by MOM, you cant blame the employer for anything.

Actually crap was supposed to be cram. Apologies if you got your knickers in a twist. At 72 my typing abilities ain't what they used to be. I didn't catch it and neither did spellchecker as unfortunately, crap is a word as well.

However the rest of my post still stands. And if your SAT said only S pass possible, then there was no way you will get the EP, full stop. The SAT is specifically to find out "if you qualify to file an application for an S or EP pass" It does NOT say if you are qualified for an S or EP pass. Big difference. The key words are "qualify to file" not 'qualified for'.

Additionally, on the original application, if the employer did not tick the following "consider for an S pass if not qualified for an EP" then you are out of luck, at least with that employer. One of the codicils of the application is if you don't tick the box to be considered for both, then that employer CANNOT reapply for an S pass with another application. However, another employer can apply for an S pass with no issue as long as you are willing to accept an S pass.

All contracts to work in Singapore are contingent on the ability of getting a work pass approved if you are a foreigner without permanent residency as a minimum. Until such time, the job seeker has no recourse to anything.
