Hi there,
I have a complex scenario and I am looking for some suggestions.
I was a Singapore PR and bought an HDB apartment along with my wife (also SPR) some years ago. 5 years go we moved out of Singapore but my wife moved back to Singapore leaving me and my child. I recently obtained Divorce as ex-party. In the meanwhile, my SPR was cancelled on account of being outside Singapore for more than 5 years. HDB tells me that I must sell the apartment within 6 months.
The problem is that I have no contact with my ex-wife and she refused to cooperate during the divorce proceedings, so we do not have any decision on division of matrimonial assets.
The question now is how do I manage this situation. I have been paying the monthly instalments from my CPF OA account (my wife also pays a part of it), also the monthly SCC fee for last 5 years while my ex-wife lived there.
I have not been able to get any lawyer till now as nobody responded.
So, I am in a fix how to handle this situation. Any suggestions?

Where was the divorce order obtained? Typically if it was obtained in Singapore the order for
property settlement would include forced sale of the HDB apartment. IF this is the case then you proceed to sell the apartment without your wife's consent.
If you don't have a court order for such then you need "remove your name" from the HDB. That means most likely losing all your equity.
In the MEAN TIME why the hell have you kept paying CPF etc? You can order CPF to stop making payments.

I'd also add that if you're ordered by HDB to do something within 6 months they can't really force you to do so.... it's more of a request although if you don't comply eventually they will reposess - in this case you might actually get some money back. PM me for a lawyers name.

Well, I got the divorce outside Singapore. There was no decision on division of matrimonial assets as it was done ex-party basis.

What you need to do I "think" if apply for a
property settlement order in Singapore. That will result in a court order for the sale of the HDB. Also use it to get child support orders for your child from your ex.
