Will employer provide Annex A to new staff

Will employer provide Annex A to new staff

Hello and Good day,

I am a Male, 23
Malaysian Chinese
2 tax years in SG (1 payable)
Applied EPR via PTS scheme

I was required to sign a 2 year bond by my current company in order to obtain the Annex A & employer letter. In which I have to stay with the company for 2 years if PR application is successful or face a penalty of up to 4 moths salary.

Can I still change job in the midst of the waiting for the EPR outcome. Will a new employer whos looking to hire help to write the Annex A and employer letter to provide to ICA?

1. Having such a clause to stay for 2 years is first of all not legal and right
2. Since you have accepted and signed, it is not fair to break that?
3. Since Malaysian Chinese applications will have slightly easier criteria to qualify, you may change jobs when your PR is in progress. Even though success MAY NOT be guaranteed. New Employer should be OK to sign the Annex A

But why do you want to break the commitment given to your current employer? if you didnt like the commitment, you should have changed jobs and then applied for PR after being in the new job for 6-8 months?

An Annex A by the new employer? Maybe, maybe not. Employers are adverse to signing Annex A for the very reason you relate. It's quite probable that the new employer will not.

It is hard to say whether the employer will sign it.
An employee becoming a PR has pros and cons for the employer.
PROS
- a slot is freed up to hire an employment pass holder
CONS
- the employee can now move easier to another company
- possible higher costs due to employer CPF contribution depending on how the company deals with conversion from EP to PR.
