DP cancelled without my knowledge by SPOUSE

Post by priyaa123 » Fri, 16 Aug 2019 5:25 am

Dear members

Due to family problems my husband cancelled my Singapore DP without my knowledge. just now i check it my DP was cancelled. kindly help me to any one to retrieve my DP. Because my certificates are in Singapore without DP i cant come back to Singapore.because now im in my home country.

In fact, in order to cancel the DP, all the EP holder has to do is to log onto the portal on the Ministry of Manpower (MOM) website and cancel the DP online. The EP holder is legally entitled to cancel the DP’s of his family members. The cancellation is draconian and immediate.

The DP by MOM caters to the increasing number of expats who are working in Singapore for long periods and want their spouse and children to live here with them.

Unfortunately, there is an increasing number of EP holders who are abusing the system and taking advantage of the “power” they have inadvertently been granted by MOM.

kindly let me know the legal way to bring back my DP
Thanks
Priya

Firstly sorry your spouse is such a passive aggressive arsehole. This is a coward's move.

Second where I have seen this happen before the only way for you to get the DP back is negotiate with your spouse and possibly his/her employer HR (I suggest you ring them directly, explain what happened and ask them to put pressure on your spouse to re-instate the DP so you can "get your affairs in order"). Another option is to come in on a SVP to retrieve your belongings. Please note your spouses employer HAS to apply for the DP again. HR who deal with expats are familiar with this scenario and in my experience have been helpful.

You should also engage a Singapore based solicitor to immediately sue your spouse for spousal and child support (you can do this prior to a divorce) and ask him for advice as to whether the Family Court can fix the DP issue or include it in the order.

Finally - I know of cases where ICA has issued visas (LTVP) to spouses in your situation. You REALLY need legal assistance.
I not lawyer/teacher/CPA.
You've been arrested? Law Society of Singapore can provide referrals.
You want an International School job? School website or http://www.ISS.edu
Your rugrat needs a School? Avoid for profit schools
You need Tax advice? Ask a CPA
You ran away without doing NS? Shame on you!

I thought only the EP holder's employer can cancel the DP on advise from the EP Holder and the EP Holder himself cant cancel it?

You're correct SF - the coward has obviously told his HR to do so.

Your DP sponsored by your husband, and your husband doesn't want to be your sponsor anymore. Thus he cancel your DP. Correct me if I am wrong.
Btw, why you can't come back to Singapore without DP? you mean come back to Singapore to work?

No they can't, unless they have the corporate login for EP Online. EP holder can login with a Singpass and update details like address etc but you cannot cancel either your own EP or an associated DP. Only the employer who requested the EP/DP can cancel them.
