Overseas employment under Singapore company

Post by tempjacq » Sat, 20 Jul 2019 10:58 am

Hi, I recently went to an interview for a company that I'd really like to work for, but they're not able to hire me due to no quota available.

If I were to be employed by them to work remotely in my home country, do they need any foreigner quota to do so? FYI I am a graphic designer thus I am able to work remotely and communicate via internet.

Another thing that bothers me is that I am actually under Tuition Grant bond scheme. According to MOE,
The following types of employment would be considered towards bond fulfilment:
a) Working locally as a full-time employee of a Singapore entity,
b) Working locally as a self-employed person where the company is registered with the Accounting
and Corporate Regulatory Authority (ACRA),
c) Working full-time overseas due to secondment from a Singapore entity (i.e. you remain on the Singapore entity’s payroll),
d) Working overseas as a full-time employee of an overseas subsidiary or a joint venture of a Singapore entity which is more than 50% owned by the Singapore entity,
e) Working overseas in a representative office overseas as a full-time employee of a Singapore entity (i.e. you remain on the Singapore entity’s payroll or the operating cash flow of the overseas office is funded from the Singapore entity).
As I will be working from home in my home country while being hired and paid by the company in Singapore, will it be considered towards my bond fulfilment?

Thanks!

It looks to me as though you could fulfil c, d or e given that scheme. Go for it!
I not lawyer/teacher/CPA.

Your rugrat needs a School? Avoid for profit schools
You need Tax advice? Ask a CPA
You ran away without doing NS? Shame on you!

Hi PNGMK, thanks for the reply! If I remained on the local payroll and pay tax in Singapore, do I need a quota to work with them even though I am not staying in Singapore?

No - quota is for folk working and living in Singapore. If they hire you and put you on their payroll but DON'T apply for an EP it will pass (and you don't need an EP as you're not in Singapore). And you won't have to pay tax in Singapore as your not resident (you pay tax in your resident country).
