Minor repairs - water leakage caused other damages, shall tenant pay?

Post by annabella » Thu, 11 Jul 2019 10:24 am

Two weeks ago, we had a leakage in our apartment caused by wear and tear of the kitchen tap. As soon as we discovered it, we called the plumber to replace the tap and we paid for our 200$ as per minor repair clause in our contract.
However, the leakage was quite heavy and it caused the cabinet door under the sink to absorb all the water. So now the cabinet door is swallowed as a consequence of the leakage. We notified this issue to the agent together with the leakage problem, but the landlord didn't want to pay for it, claiming we have to pay 200$ for every item.
We said it's a consequence of the leakage and she sent her contractor to assess the damage.
When the contractor came to our place, we discovered landlord wanted him to say that the cabinet door was damaged by the moisture collected while washing the dishes. He then said that it was actually the consequence of the leakage, since such damage could only appear when a lot of water came in contact with the door.
When the landlord reported what the contractor said she told us that it's very unlikely the cabinet door was damaged by the leakage and it was caused by the moisture instead. (Which the contractor excluded when he was here).
We're still arguing with the landlord to fix the item and that she should pay for it, not us, since we paid our 200$ already, this is a consequence and she tried to scam us as well.
What do you think? How can I proceed?
Please help, I'm going crazy with this landlord!

Persist with your claim. IF she persists ask her to take you to the SCT to claim. Get on record what the contractor said (even as a text message) and show the magistrate.
I not lawyer/teacher/CPA.

But does it make sense to go to SCT for such a small issue? Isn't that more expensive than just change the cabinet door?

It makes a lot of sense to THREATEN the landlord with SCT to get what you want. You do it a step at a time. First, you get a lawyer to write a letter stating that if the matter is not resolved promptly, it will be escalated to SCT. After that, you make your next move based on what the LL does.

The thing is: asking a lawyer to write a letter will be more expensive than paying 200$ for the replacement of the cabinet. Of course, I know we shouldn't pay for it and that if we get in court we'll win, but at the same time I'm worried that "being right" will be more expensive than the 200$ she wants us to pay. What do you think?

You don't really need the lawyer. Just respond:

This was a single incident of a tap leak and subsequent damage as evidenced by the contractor and not a separate incident caused by our actions as you allege. The fee we paid is as per the TA for this single incident. We will not any further charges to us for this incident nor will we accept any deductions for this incident from our deposit at the end of our tenancy and we will take action at the SCT to ensure such. We demand prompt repair of the cabinet as per your obligations in the TA.
