Pedantic MCST and parking.

Post by The Ref » Mon, 01 Jul 2019 2:21 pm

This is more a rant, but I informed my MCST I was buying a motorcycle and requested a parking permit.

The reply is that Motorcycles are not allowed - when questioned it was stated that no park was specific for motorcycles.

The noticboard say the allocation is one vehicle parking lot per unit but must display a "car lable" (really just a sticker printed by the MCST. There is no signage saying no motorcycles and a passive-agressive flyier got put in the letterbox banning motorcycles. The MCST have threatened to clamp or tow any motorcycle in the property.

I believe they are just making it up as they go and there is no grounds in law, but why do MCST people make lives of everyone difficult.
They refuse to return my call and I really dont want to make a formal complaint but they make it difficult.
The MC cant make any by-law that prevents the legal use of common facilities, but they can make parking by-laws.
AAGH!!!!! ](*,)

Yes this can be a problem. I should have warned you of it. However my reading is this - if you can get your motorbike into the carpark they really can't remove it no matter how much they bluster if they don't have a specific bylaw allowing them to do that.

You need to get your landlord on side too. Owners have far more influence with MC and MA than tenants IME.

I talked to the MC - well I left 3 messages and the third was that they were hiding from me until after the ban comes into effect - that at least got a call back. I asked them when the specific resolution was passed and if it was passed by over 75% of votes. Bottom line there is no by-law and the comment is that the lines drawn on the ground are the size of a car and there are none drawn the size of a motorcycle :o .
The MSCT published documents state 1 vehicle per unit and that there are two seperate laws that prevent blocking the lawfull use of common areas (such as a carpark), Limiting it to one carpark is fair use - but blocking access is not.
MC said they have to take it to a general meeting so I need to get my Owner to attend and start talking to others in the block.

Yes this "motorbike cannot use car lot" is a pretty unique Asian thing.

Hi The Ref,

Did your issue get resolved?
I am going through a similar challenge now. McST is asking me to pay for parking my car since I already had a motorbike and they consider the car as my second vehicle!

Common in other countries actually. Most municipalities in the UK prohibit it. E.g. https://www.brighton-hove.gov.uk/conten ... rcycle-bay
