I have a 3 month notice period in my contract. Which I am requesting my employer to reduce as I have to join my next company in 1 month.
My present company is refusing to let me go before 3 month.
What are the options I have apart from requesting. I tried to tell them that I agree to buyback then also employer not agreeing.

What is written in your contract if they want to release you early without termination?
What type of employment permit are you holding and your salary level.

My contract says that If they want to release me early then they can pay me salary in lieu .
But nothing saying that I can compensate.
I am on EP. Salary more than 7k.

Reread PNGMK's post above. As your salary is outside the purview of the MOM (Ministry of Manpower) you will have to work under the civil court. What remedies you have available to you I cannot say. You will have to talk to a lawyer as 2 month's salary is a fair bit of bread. Normal Employment law under the Employment Act say it has to be equal both ways. Either party can pay salary in lieu. Mutual agreement can waive said penalty but without agreement you should be able to pay salary in lieu. I'd tell them you can take the 2 month's salary in lieu or you will see them in court. Or you could give them a cashier's cheque for 2 month's salary and then go to the MOM if they will not cancel your employment pass. But check with a lawyer first!

By all means. And apologies for my incorrect information. That came into law since I retired at the beginning of March this year (3 months ago). Good to know as I'd hate to be giving out incorrect info after 15 years on here! Many thanks for letting us/me know. But yeah, as all are covered now then whatever in written for the employer also goes for the employee. You might just want to initally let the employer know about the upgrade of the MoM laws before you go straight to TADM/ECT. Give them a chance to rectify the situation so that neither party loses face if you know what I mean. Keep us posted on the outcome, okay?

One more question:
When offsetting notice period with leaves.
Do I subtract working days only or include weekends?
Eg. 21 June less 10 leaves is 7 June or 11 June?

Off days do not count. If you work a 5 days week, then two calendar weeks (14 days) is 10 days annual leave if offsetting (7 June in your example).
