Hi All,

I'm considering to apply for SC. My profile as below :
- Malaysian Chinese
- SPR for 5 years, renewed REP
- Wife (also Malaysian Chinese) with a baby boy

Previously applied for SPR together with wife with me as the main applicant. What will happen to her PR if i proceed for SC application, would she be scrutinized again for her PR ? She plan join us but only in a later stage. Currently this application would be for me and baby.

Any ideas for the chances of SC application ?
How long would be the E-appointment date for now, June 2018 ?
Anyone with similar cases like us lately ?

You can apply for SC for you and the baby. They might ask you during the SC application on why you are not applying SC for your wife. If you have valid reasons, provide to them when they ask.

If you apply as a family, there are high chances that you will receive the SC for all.

I was Malaysian Chinese too recently converted to SC.

Your SC should definitely be okay to be approved in around 4 months time.

For your wife, her REP can always be renewed under your SC sponsorship. Criteria for you to sponsor upon attaining your own SC is just to stay in SG.

You can apply for SC for you and the baby. They might ask you during the SC application on why you are not applying SC for your wife. If you have valid reasons, provide to them when they ask.

If you apply as a family, there are high chances that you will receive the SC for all.

Currently wife is holding property in Malaysia and thinking it would be easier to dispose it off, then later convert rather than bringing a lot of uncertainties together. Ex : Taxed after selling as a foreigner and etc.

I'm currently looking into more details as to what to do with all these. Property, stocks, bank accounts ?

Yes, do understand that with application as family would have a higher chance. We were also debating about the waiting time, as in if i apply alone with baby, and then after 1 year later we got rejected then we would have to go thru again with a lot of time wasted and possibly some benefits that came along. Now with the child as LTVP, we are paying higher for vaccination too.

I believe the current appointment time is about 4-6 months away. So it means your approval is 4 months after the submission / interview ?
Applying alone with baby or the whole family ?

For Wife PR, if I apply alone, her PR will not have any changes right ?

I got an important update regarding property ownership in Malaysia:

It's possible to convert to SC while keeping the property in Malaysia. After receiving SC, need to provide status update to bank. It's only when selling the property it will be tax as a foreigner.
Foreigner tax is 30% on gain after disposal. Example below :

Malaysia Property Gain Tax for Foreigner – How does it work?

The Malaysia’s Property Gain Tax for foreigners takes into account all bills for legal fees, stamp duty, maintenance of the property as well as real estate agents’ fees, which you would have paid for when placing a deposit for the property.

Example based on latest 2014 new tax rate:
In February 2011 – you brought a condominium at MYR 580,000
In February 2014 – you sold at MYR 670,000
After 3 years, your gain will be MYR 90,000

You can deduct these expenses paid for the property:

Legal fees and stamp duty during purchase – MYR 12,760
Loan legal fees and stamp duty during purchase – MYR 11,800
Agency fee paid to dispose your property – MYR 11,500
Renovation costs paid – MYR 10,000
Legal fee paid during selling – MYR 1,500
Total expenses paid – MYR 47,560

Net gains on the property : MYR 42, 400
Tax rate to pay will be MYR 42,400 x 30% = MYR 12,720
In actual fact, you only pay approximate 1.8% tax rate on your selling price.
There is no difference in Malaysia’s Property Gain Tax Rate for foreign-owned property title name under individuals or companies.

While it may seem a lot, but after considering fees deduction and all expenses, i think it's not a huge loss.

The RPGT rate for foreigner becomes 5% in the 6th year after date of acquisition. Also, you may want to exercise the 'once in a lifetime' exemption while you're still a Malaysian.

If we get SC approved after 6 years of owning the property, will it be considered as 5% ? As technically we are selling as a foreigner after that. Or it doesn't matter, only considering how many years we have bought it ?

I'm still single. Yes you are correct. It's 4 months from the time that I went to ICA for submission of documents.

Applying with family should be fine. Didn't see any issue or delay possible for your case.

You can keep checking the appointment availability online. When someone cancels, you may get an earlier slot. I think you are allowed to change your appointment date for a maximum of 2 times.

2. Make appointment through e-Appointment first and then submit documents and forms on the appointed day?

Even if you submit your application online via ESC, you are still supposed to submit the additional documents (copies) via the counter at the time of interview.
