Main tenants vs tenants

Post by Leevoonwooi » Thu, 16 Nov 2017 9:45 pm

Guys , thank you for reading this
I reallt need your professional advice on this issues.

I rented a whole apartment (HDB 3
Plus 1 room) we are 5 tenants under this premise and I am the main tenant. Which I am the one who signed the landlord and tenant agreement. We didn't sublet the other 2 rooms to the other tenants as the others tenant name are in the landlord-tenancy contract, but is just I am the main tenant who signed it.

Few weeks back , one of the tenant want to move out and only give us less than a week notice. After she moved out, she didn't find replacement and threaten us to pay her back the deposit.

The deposit is with the landlord but the landlord expect me to settle it because I am the main tenant. The problem is , the tenant threathen me that if I don't return the deposit they will sue me. They say they didn't sign any agreement between the main tenant and the tenants so I have to pay return them the deposit. They keep threatening us they will sue us for subletting the room but we never accept any extra money from them. And we agree at the first place that we will share an apartment together but I will take the responsibility to sign the contract.

I need to know if
1.) the landlord-tenants agreement have their name but they didn't sign it, can the one month deposit be forfeit due to early terminated?

2.) are they able to sue us that we are guilt for sublet. But at first we promises to move in togetehr but we are not blood related (family). Is that still consider Sublet ?

Good Lord.

Nice friends you have there.

Are you terminating the whole lease ?

If their name is in the agreement there is no issue about sub let or no.

To sue she'd have to take you to court or the SCT. I doubt she'll do that. Tell her you'll pay her deposit from the new sub-tenants deposit when they move in or wait until the main lease is terminated and the entire deposit is returned.
