Mustafa-Shoplifting 35$ - Indian tourist

Hi,

Need help for one my indian friend tourist in Singapore from past one week for two more days stay. He was arrested for shop lifting yesterday (Mustafa-perfume-35$ shoplifting), currently he is release by IO and asked him to meet on Tuesday (23, May).

In his statement he said he is remorseful and he has done first and last time this kind of offence. Though he bought few things and paid for it , in total he paid around 90$ and 35$ dollar he didn’t paid.

IO told him that he is considering his remorselessness and acceptance of apology and warning him and releasing him now but he will show the case to prosecutor. And if prosecutor think that he need to go on charge then case will go to court and based on judge judgement either there will be jail or fine.

Though he said hopefully you will be asked to go back to your country by Tuesday or Wednesday but it may take a week time too.
Please suggest when can my friend go to his country and like generally what happen in this kind of cases. He is ready to pay fine too if required.
Please help him he is very scared and want to go back to his country ASAP.
Any idea how much time it will take to get him back to his country generally.

if it was a genuine mistake he should have challenged the decision.

On the other hand if it was intentional - hiding the perfume - good luck.

It can take anything till 2 to 4 weeks. If the IO is kind.

If he is prosecuted 99% chance he will be found guilty and prison is possible for sure. Regardless a conviction will result in a permanent record that maybe available to other jurisdictions. He probably should retain legal counsel.

I agree on the idiot part. What do you think quantum of punishment can be. What are the chances that prosecutor may not charge him.

admitting to the crime in Singapore so far rarely won consideration..

And Mustafa security always will refuse to drop charges.

So high chance he'll be locked up. Very low chance the charges will be dropped and deported.

Nobody here is a solicitor or barrister - if you want specific answers then your 'friend' needs a lawyer. However the most recent shoplifting case on here resulted in a fine and she was a repeat offender so perhaps he will get off.

For all those people who might refer this post in future: (Based on my friend's case experience)

1) Never ever try to do stealing in Singapore- small or big amount. NEVER, this country is safe for a reason, laws are strict and never ever try to play with that. RESPECT Singapore!
2) Unfortunately, you caught stealing, better accept the mistake (If you are guilty).
3) Don’t ask too many questions when they arrest or when IO talks with you (Cooperate with police always).
4) Singapore expats experts might comment based on their experience so it might not true in all the instance, As off course not in this case too (not even slight near), they scared my friend with extreme responses.
5) Once you got caught, they will take you to the lock up (I am talking about stealing of low amount might be up to 300 $) you might be locked up overnight, IO will talk to you, If you accept the crime, He will leave you and ask you to come later, as case will go to prosecutor.
6) Prosecutor will decide whether case will go to court or he/she will give stern warning and leave with passport or any other document which they held. (Duration will be like 3-4-5 days in case of tourist from leaving you till calling you again)
8) This case observation: Prosecution wont charge for minor crime (like 35$ stealing ) in this case, they will give you stern warning and return your passport provided you are clean in the past.
But If in case they charge you, your case will go to court and court will decide whether you should be go to jail or not. Most of the time based quantum of the crime cases will go to court.
Verdict of this case : Passport return my friend going back to India
One advice to singapore expats: If you do not know things dont suggest something extreme, remember irrespective of anything you are here to help people not scare.

Though I would suggest this : if you can't stand advice, especially from those who have seen and felt others personally in similar circumstances, don't ask for it. Especially if you only want sugar coated answers....

PS, your friend, (or was it you ?) got off easily, lady luck has been smiling on him a lot.

PPS, I know a person who's staff got deported for a similar crime, and the value of the item was 50$ I think. So, yes, steal something below 35 $ to have the same outcome as your friend, am I correct ?
