Sign This or We Fire You - Legal ?

Post by martincymru » Tue, 09 May 2017 3:45 pm

Domestic Helper asked ("forced") to sign document by Agent and existing Employer.

"I agree to be barred from the Casino......"

She was told "if don't sign, we send you home....".

Is such a thing Legal? Morally bankrupt? Where next...?

//
Aside, we increasingly this kind of thing (e.g. IRAS "...sign this giving us access to everything....").

Is there any more context behind this?

i.e. was the maid having problems or causing problems because of gambling?

In my personal view, morally bankrupt.

Probably legal. I can't remember what the standard contract says about notice & termination.

I know of a similar case. The employer, without maid's knowledge, had her barred from the casino.

When the maid found out she changed employers. She still can't access the casino, seems only the original employer can reverse. Not that it's a problem, she never planned to go anyway. Employer was western.

Morally bankrupt, but then again, maybe the employer heard of a friend's friend's friend's maid who did a runner with loans ..

Not necessarily from Casino .. one can easily spend a few hundred $ in Singapore pools.

Illegal ? Grey area.

The form is supplied as standard with the other paperwork by the agencies - I think the agencies are pushing this to help their maids. I personally would be quite happy to see both casinos catch fire and end up as smouldering ruins so I am biased however I did not sign this for my last maid; "Lia the Moron".

It is legal IMHO to include such clause to a contract but of course if the contract was already in place nobody can force her to sign to include some additional restriction. The question is, from a purely practical perspective, what she can do about it.

This form is also provided by MOM Work Permit Online when MOM approved the domestic helper work permit.

Looks like it is a requirement by MOM and compulsory for the domestic helper to sign.

Fascinating. Seems even some government departments have worked out that the PAP should never have allowed legal gambling (aka organized crime) in Singapore.

on a related positive note, MOM has tightened the insurance requirements for FDW. From the time they landed to the time they left Singapore, instead of the current grey areas / nobody is responsible if something happens while under the care of agency etc etc. Somebody is listening ...

I did read MOM's guidelines, specifying what must be covered. Not sure if any insurance company agreed to play ball with MOM's guidelines.
