Personally I would be very careful trying to influence the judgment stating facts only indirectly related to the case. For example, how relevant would be to say, that the LL lied in the police report? Also, what Taxico already mentioned, it's good to realize what can be proved and what not.

Sorry I didn't realize this thread had gone on to page 2. Apologies for this late reply.

In her claim she alleges I am "uncontactable". I defend myself by saying I have always been contactable - service call records from her to prove my point.

But in general I think the owners have not been forthright. From the outset they could have informed me of the work to be done at the time of polling or even at the time of upgrade selection. The fact that they participated in these activities and did not inform us could be breach of the agreement.
