Overseas born child without fathers name in birth cert, applying for SC

Postby MaxIce » Fri, 15 Jul 2016 12:50 am

Hello everyone,

I would like to apply for SINGAPORE citizenship for my boy but he's born in Vietnam before me and my wife has registered our marriage in Singapore. So the birth cert in Vietnam for my boy does not have my name in it.
Anyone able to give me advice on this situation on how i can apply for Citizenship for him?
On a side note i have done a DNA test to prove that he's my boy just incase ICA needs it.

So can i just take the DNA test results and the necessary documents required by ICA to apply for citizenship via ICA straight, OR
Do i need to go back to Vietnam and get my name to be in my boy's birth cert then i go to ICA and apply?

Greatly appreciate all advices given!!

Cheers [-o<

Unfortunately, from your description, your son is not eligible unless his mother was/is a citizen of Singapore (but with some conditions). Details are available here. However, with proof of paternity you should still be able to sponsor him for immigration into Singapore -- LTVP, Student's Pass, or Permanent Residence, as examples. He would then have a path to PR and citizenship if he chooses (and if the government agrees).

I would desperately try to have the VN birth certificate issued with the fathers name on it (yours). AFAIK the Singapore constitution would then automatically allow your son Singaproe citizenship (regardless of the state of the marriage prior to the birth). The constitution is online and worth reading.

Assuming the child isn't one year old yet.

The key is.
When the baby boy born, is his father and mother legally married in Vietnam.

Quote from https://www.mfa.gov.sg/content/mfa/over ... scent.html

1. The father, who is a Singapore citizen by Birth and has a lawful marriage,
2. The father, who is a Singapore citizen by Registration and has a lawful marriage.
