I do agree on that .. the fellow may have been killed later ..x9200 wrote:Not enough details but likely the prosecutor sees something wrong in the way they handled the robber after tiding him up.
It is "ok" if they have killed them defending themselves but it is not ok, if they killed him when he was already incapacitated. It is also not ok if they left him to bleed to death.
There was a protracted court case some years ago in the UK; 'The Tony Martin Case'. He was a farmer in the country, who was repeatedly being targeted by burglars.ecureilx wrote:Or does it mean, you should kill the person defending yourself, than hurt him enough and wait for the cops and the fellow dies, you are in bigger trouble ??
Then again, this not being UK, the case may go in favour of the resident ..JR8 wrote:It'll be a $Big-Ticket day for all the lawyers involved, that's for sure...
The point of me quoting that was to highlight the core legal consideration in the case, it wasn't a comment on the outcome (which BTW caused large popular outrage).ecureilx wrote:Then again, this not being UK, the case may go in favour of the resident ..
BTW, another old news from PC England [link]
Or maybe MY cops scared somebody did their job ?PNGMK wrote:They went far beyond self defense I think. For the MY police to even consider charging them they must have some strong evidence of serious damage done.
No I don't think so. I suspect the MY cops would not normally over-reach in this situation. There, as I said, must be some good forensic evidence that the chap was tortured/hurt/strangled whatever in a deliberate, planned manner following the successful self-defence. Also we do not know if the alleged burglar (?) was even such a thing - he may have been a former lover, unwanted guest etc.ecureilx wrote:JR8 ..
