If he ended up paying a fine in a court, it means that he was bringing in WAY more than someone should, we're talking about several cartons here. Because even if caught for cigarettes, bringing anything from one pack to one carton will likely still be excused by customs by paying the relevant customs levy on them (of course, it helps if you don't rile up the officer unnecessarily). More than that, see you in court.

That said, one never knows until your brother tries entering the border.

Transit should be ok as you don't have to pass immigration (passport control).
