Transfer Maid - Wants to go to new agency

Post by sonaliahuja » Tue, 01 Jul 2014 11:17 am

Hi,
My helper of 1.5 yrs does not want to work with us. Am ok with it.

She wants to go a new agency and not her old one.

Wants me to sign release document.
Please advise.

Regard,
Sonali.

I am not sure but there must be some issues around responsibility and accountability. I believe as her boss you are still responsible for her for a period of time (to be agreed with the agent) until she finds alternative work.

Also if you want to hire a new maid there may be problems if the previous maid is still officially registered with you at MoM.

If I were you I would contact MoM and ask their advice. Others here may be able to contradict or verify what I have said with their greater knowledge.

when the employer signs the release form and either the maid gets a be employer or is repatriated there is no obligation from the employer

agencies will process the rest

I suspect the current agency is treating the maid as their personal property and advising the employer accordingly ....

since maids switching agency means she learnt her right plus the right to claim back the months of salary deduction from the previous agency .. and agencies have to pay back the placement fee ....

even then the previous employer is not affected other than the previous agency throwing tantrum at the employer for releasing the maid...

just me taking a stab on worst case scenario
