Termination by employer without notice

Post by eren_jaeger » Sun, 21 Jul 2019 6:47 am

Hi so my probationary period should be 3 months working for this company but after 1 month into the job, I was being asked to leave because they found that I am not the right candidate for them.
The employer contract states that
"At any time during this probationary period, the Company may terminate your employment without cause and without advance notice or pay in lieu of notice. If this occurs, we would have no further obligation to you, financial or otherwise."
So before I left, I was asked whether I want to be given termination letter or hand over resignation letter. I chose to resign instead because I thought that being terminated will leave a blackmark on my next job search.
My question is: even though the contract spells out as that, do I get any chance to seek protection under MOM ? What kind of protection can I get?

As you resigned the question is moot - you should always be fired in this case unless they offer some financial compensation to resign. MOM offers no protection in that case and anyways only offers protection for those earning less than XXX (I can't remember - loook it up).
I not lawyer/teacher/CPA.
You've been arrested? Law Society of Singapore can provide referrals.
You want an International School job? School website or http://www.ISS.edu
Your rugrat needs a School? Avoid for profit schools
You need Tax advice? Ask a CPA
You ran away without doing NS? Shame on you!

1 day notice is sufficient under the law. That is, on the same day you tender.

Difference between termination and resignation: if you used an agent, termination will entitle you to a refund of your Singaporean employment agency fees. Resignation won't. That's the key difference under law that will likely apply to you. Either way it's a termination of employment and same day notice is sufficient.

What protection do you want? Anyone did anything wrong? What do you feel "entitled" to?
