Advice pls. Me PEP, ex was on DP LOC

Post by The Ref » Tue, 29 Mar 2016 10:54 pm

My divorce is about to be finalised and that will cause the cessation of the ex's DP, and therefore the LOC she is working on will no longer be valid.

As she wishes to stay here with the children, what are the realistic options for her to keep working?
She is working as a shop manager but has a degree.

a) she gets an EP of her own. Best option but hard to get without specialist skills.
b) If I form a company and attempt to get her an EP / S Pass working for it and then contract to her employer. I doubt this application for EP / S Pass would be approved.
c) PR? would she be able to get PR without the kids getting PR also as they would stay on my DPs
d) Other options???

Thanks in advance.

Yep. What kind of degree/experience she has?

b) If I form a company and attempt to get her an EP / S Pass working for it and then contract to her employer. I doubt this application for EP / S Pass would be approved.

If (a) = common degree with little experience then I guess it is going to be difficult unless you get creative.

c) PR? would she be able to get PR without the kids getting PR also as they would stay on my DPs

Not a chance without her having a job and a number of other factors fulfilled.

d) Other options???

The kids, studying here? She may get LTVP based on this and after 1 year may get a work pass / LOC based employment.

If you are willing to go that far to provide her with an EP, why didn't you just stay married and only sign a deed of separation etc? She insisted?

Hey Ref sorry to hear about your divorce. But I agree with X9200, if you're going out of your way to keep her in Singapore for the children, why not stay married? (I know this might be personal so I'll leave it - plus you're already going through the final stages of your divorce)

Another option she and your children can consider is this:
1. Your children transfer from DP to Student Pass (need to check the eligibility for Student Pass first)
2. She could apply LTVP as study mama (accompanying female relative to foreign students)
3. Refer here for study mama status http://www.ica.gov.sg/page.aspx?pageid=174
4. Note: Your children may not be qualified to move from DP to Student Pass because of your status or their residence address or even the category of school they are enrolled in.

Thanks x9200 and Lynx

She has a B. Bus marketing degree but not really used it in 15 years. Last 15 -5 years ago part time work, 5 - 1 years ago moved to SG not working, started working about 1 year ago after divorce started.
She moved 1 child onto a student visa to ensure she would get a Study Mama visa but that means she cant work for a year and to be honest that just breaks the finances.

I needed the divorce for reasons I wont go into but marriage has been dead for many, many years.

I like the idea of a company but whether that works or not is a gamble.

Theoretically PR is possible, but the timing is awful if your/her divorce is about to be finalized. Ideally everyone would have applied for PR before the divorce. She can still try, but the odds are not good, and it's not a speedy process.
d) Other options???
d1) Postpone the divorce, and arrange separate, appropriate, but still legal housing (if you haven't done that already).

d2) Your ex-wife moves to Johor Bahru, under the MM2H program for example, and the kids alternate between households, with the kids concurrently holding legal immigration status in Malaysia. MM2H doesn't allow employment, but the cost of a second household (and schooling) in JB is much lower, so this could work better financially. (And there might be other immigration options besides MM2H.)

d3) Your ex-wife quickly, legally marries an opposite sex Singaporean citizen, permanent resident, or sufficiently high earning EP or PEP holder, and gets a LTVP or DP on that basis.

d4) Your ex-wife gets pregnant and gets a LTVP to deliver in Singapore, which postpones the day of reckoning for a few months.

....OK, I'm trying to think creatively here. D4 is probably a bad idea.

d5) Pack up and move to a country where everybody has legal immigration status without the marriage.

d6) Plane tickets and a lot more Facetime, Skype, etc. :(

d7) the wife wins under 4D (or any other suitable) few millions $$$ and applies for PR under GIS
d8) the wife learns how to dive (maybe she knows already), finds a treasure in a sunken ship and applies for PR under GIS
d9) the wife wins some "have a talent" show, become popular, rich and gets invited to settle down in Singapore
d10) The Ref manages to convince the SG and his country of origin (AU?) gov to form a union where all the citizens of the respective countries have right to work on both territories
d11) Malaysia conquers SG and introduces selective Shariah law making all divorces void for past 10 years. The wife's DP and LOC gets restored.

This is getting ridiculously funny.

On a serious note, @Ref you should really consider if:
a) your ex's proximity to children is a priority, or
b) your proximity to children is a priority, or/and
b) if your children being in Singapore takes higher priority over her status in Singapore.

Because another option is to send your kids/ex-wife to your/their home country where they have residency status without issue to schooling and employment options.

I'm sorry to hear about your divorce Ref.. not sure i am knowledgeable enough to contribute in any other way in this thread.
but I assume you should be looking for the best outcome for both of you and your future plans if any in Singapore.
To get there early is on time and showing up on time is late

As a PEP you can form a company and be its shareholder but you cannot be a director... so... who is going to run it for you... can't be the ex... she hasn't got a work permit.
