In law, I believe you will need his signature on the birth certificate attesting that he is the father? If you are divorced, we cannot say as we don't know the grounds for divorce or even if he's the father as you didn't give us any data to process.

It will distributed by the Public Trustee in equal shares as apparently the deceased did not leave a will, therefore the estate is handled by the Publich Trustee. You will probably be required to have a physical before the LOC is issued.
